The official binaries are not licensed under the same license as the source code is. See [https://github.com/Microsoft/vscode/issues/60#issuecomment-161792005 here] a comment from a VSCode maintainer that describes the process of how the binaries listed on Microsoft's official website are modified before compilation.

Is Visual Studio Code free software?

It seems that the source code is under MIT... but the binary form is freeware:

I don't believe Visual Studio Code to be free software

The official binaries are not licensed under the same license as the source code is. See here a comment from a VSCode maintainer that describes the process of how the binaries listed on Microsoft's official website are modified before compilation.

VSCodium, however, is free and binaries are licensed under the same license as the source code.
